The success or failure of a pharmaceutical company in China is increasingly linked to its IP strategy. Yet there is much misunderstanding about the current state of IP protection for pharmaceutical inventions in China. Tutorial Leaders:

Tony Chen, J.D., Of Counsel, Jones Day (Shanghai)
Mr. Chen has 13 years of experience working with high-tech and biotech companies in the United States and in China. His practice focuses on patent prosecution and litigation, technology transfer, and formation of technology start-ups. In China, he has represented multinational companies to enforce their intellectual property rights in civil actions and through criminal sanctions. He also has represented Chinese companies to build and acquire intellectual property on a worldwide basis. In addition, Mr. Chen is a member of an advisory board to the Shanghai government and consults the government on life science industry and intellectual property matters.

J. Benjamin Bai, J.D., Ph.D., Of Counsel, Jones Day
Dr. Bai has an extensive patent opinion practice and has rendered legal opinions regarding patentability, patent infringement, and patent validity in the fields of chemistry, chemical engineering, nanotechnology, materials science, and biotechnology. He has prepared and prosecuted hundreds of patent applications involving polymers, chemical processes, well completion fluids, oil services technology, pharmaceutical compositions, biomaterials, animal feeds, lubricants, semiconductor devices, consumer products, drill bits, and other items. In addition to his U.S. patent practice, he is devoting a substantial amount of time to China-related IP issues. He assists multinational companies in obtaining patents and trademarks in China and provides strategic advice to them on how to enforce their intellectual property in China
